Welcome to Find me+ App!

The company FIND ME PORTAL LLC ("Company"), which owns and operates the Find me+ app on the Apple Store and on the Google Play Store (collectively referred to as "App"). By downloading, installing, or using any version of the App, you agree to be bound by this Agreement. If you do not agree to these terms, do not download, install, or use the App.

We have drafted these Terms of Use (referred to as "Terms") to inform you of the rules that govern our relationship with you as a user of Find me+ or any of our other products or services (collectively referred to as "Services"). These Terms constitute a legally binding contract between you and Find Me Portal LLLC Company, so please read them carefully. By using any of our Services, you agree to these Terms. If you agree, Find Me Portal LLC grants you a non-transferable, non-exclusive, revocable license, without the right to sublicense, to use the Services in accordance with these Terms and our Privacy Policy. Of course, if you do not agree to the Terms, do not use the Services.

1.Additional Terms for Specific Services
Additional terms and conditions may be outlined on our Terms of Use and Privacy Policy pages. By using our services, you agree that these additional terms may apply and will become part of this agreement. For instance, if you purchase or utilize any paid features available within Find me+ (such as a Find me+ Premiumsubscription or emojis), you acknowledge that our Paid Features Terms apply. In the event of any conflict between these additional terms and the main Terms of Use, the additional terms will take precedence and apply instead of the conflicting sections while you are using the services to which those additional terms pertain.

2. Who Can Use the Services
Our Services are not directed at children under the age of 17, and you must confirm that you are at least 17 years old to create an account and use the Services. If we learn that you are under 17 (or the minimum age allowed to use the Services without parental consent in your state, province, or country, if higher), we will stop providing the Services to you and delete your account and data. By using the Services, you represent and warrant that:
• You can enter into a binding contract with Find Me Portal;
• You are not a person prohibited from receiving the Services under the laws of the country where you live or any other applicable jurisdiction;
• You are not a convicted sex offender; and
• You will comply with these Terms (including Privacy Policy and Social Interaction Guidelines) and all applicable local, national, and international laws, rules, and regulations.

If you are using the Services on behalf of a company or other entity, you represent that you are authorized to bind that company or entity to these Terms and that you agree to these Terms on behalf of that company or entity (and all references to "you" and "your" in these Terms will mean you, the end user, and that company or entity).

In short: Our Services are not directed at anyone under the age of 17 or the minimum age that applies in your jurisdiction. If we find out that you are under this age, we will stop your use of the Services and delete your account and data. Other conditions may apply to certain Services that require you to be older, so please review these Terms carefully.

3. Rights You Grant Us
Many of our Services allow you to create, share, and store content. When you do, you retain ownership of any rights in that content. However, you grant us a license to use that content. The scope of this license depends on the Services you use and the settings you choose. For all content you submit to the Services (including public content), you grant Find Me Portal LLC a worldwide, royalty-free, sublicensable, and transferable license to host, store, use, display, reproduce, modify, adapt, edit, publish, analyze, transmit, and distribute that content. This license is for the purpose of operating, developing, providing, promoting, and improving the Services, and for researching and developing new ones.

We refer to any content you submit to public areas of the Services, such as public profiles or maps, as "Public Content." Since Public Content is inherently public, you grant Find Me Portal LLC and other users of the Services an unrestricted, worldwide, royalty-free, irrevocable license to use, reproduce, and share that Public Content.

To learn how to control who sees your content, please review our Privacy Policy. All Public Content must be appropriate for people aged 17 and above.

While we are not required to do so, we may access, review, screen, and delete your content at any time for any reason, including providing and improving the Services or if we believe your content violates these Terms or any applicable laws. You remain solely responsible for the content you create, upload, post, send, or store through the Services.

We always appreciate hearing from our users. However, if you provide feedback or suggestions, you acknowledge that we can use them without compensating you, and without any restriction or obligation to you. You agree that we own all rights to anything we develop based on your feedback or suggestions.

4. Privacy
Your privacy is important to us. You can learn how we handle your information when you use our Services by reviewing our Privacy Policy.

5. Content Moderation
Much of the content on our Services is produced by users, publishers, and other third parties. Whether this content is publicly posted or privately transmitted, the responsibility for it lies with the user or entity that submitted it. While Find me+ reserves the right to review, modify, or remove content that appears on the Services, we do not review all content. As such, we cannot guarantee that users or their content will comply with our Terms, Social Interaction Guidelines, or policy.

Users can report content or accounts for violating our Terms, Social Interaction Guidelines, or policy. Find me+ reserves the right to moderate, review, and remove content that violates our Terms, including our Social Interaction Guidelines, which outline unacceptable behavior and prohibited content.

If you have any complaints or concerns, you can use the complaint form available here or use the options available within the app. If you follow this process, complaints must be submitted within six months of the relevant decision.

When receiving a complaint, we will:
• Ensure the complaint is reviewed promptly, fairly, and seriously;
• Reverse our decision if we determine our initial assessment was incorrect; and
• Notify you of our decision and any available remedies promptly.

• Reporting Violations
  If you believe that any content or user behavior violates our Terms of Use, please report the issue through our Reporta Safety Concern page. Our Trust & Safety team will investigate and take action as needed. You can also reach out to our team via the Support page for additional assistance or questions.

• Our Team and Support
  The Find me+ Trust & Safety Team is available 24/7 to review reports and ensure that our community guidelines are upheld. For any questions or further clarification on these terms, please visit our Support page.

In short: Most of the content on the Services is owned or controlled by others, and we do not control or take responsibility for it. We have Privacy Policy and content moderation processes in place that apply to the content on the Services.

6. No Tolerance for Objectionable Content
We do not tolerate objectionable content or abusive behavior in the Find me+ app. Users are prohibited from posting or sharing content that is illegal, harmful, offensive, harassing, defamatory, obscene, or otherwise inappropriate including our Social Interaction Guidelines. This includes but is not limited to:

• Content that promotes violence, discrimination, hate speech, or abuse of any kind.

• Content that infringes on intellectual property rights.

• Content that violates any laws or regulations.

Users who engage in such behavior will be subject to immediate removal of their content and may have their accounts suspended or terminated without notice. The Find me+ team will review and act on any reports of objectionable content within 24 hours. All users are expected to adhere to our Social Interaction Guidelines, which outline our strict no-tolerance policy for objectionable content and inappropriate behavior. Violations may result in the suspension or termination of your account, and content removal.

You can report objectionable content directly through the app, and we will take action to remove such content and block or eject the user responsible.

7. Respecting the Services and Find me+'s Rights
Between you and us, Find me+ owns the Services, including all related trademarks, copyrights, software, content, and other proprietary technology. You must respect Find me+’s rights, which means, among other things, you may not do or attempt to do any of the following (and doing so may result in your access being terminated or suspended):
• Use Find me+'s trademarks, logos, icons, widgets, look and feel, product designs, photographs, videos, or any other materials made available by Find me+ through the Services without express written permission.
• Violate or infringe on any copyright, trademark, or other intellectual property rights of Find me+ or any third party.
• Copy, modify, archive, download, upload, disclose, distribute, sell, rent, or broadcast the Services or content without express permission.

In short: You must respect our Services and intellectual property, and avoid actions that could violate our rights or the rights of others.

8. Respecting the Rights of Others
Find me+ respects the rights of others, and so should you. You may not use the Services, or enable anyone else to use the Services, in a way that violates or infringes on the rights of others. If you provide content to the Services, you agree that you own the content or have all the permissions necessary to submit it.

In short: Ensure that you own or have the rights to use any content you share on the Services. If you use someone else's content without permission, we may terminate your account.

9. Security
We strive to keep our services safe for all users, but we cannot guarantee it. This is where you, as the user, come in. By using the services, you agree to always comply with these terms, including our Social Interaction Guidelines and Privacy Policy to maintain the safety of the services. If you fail to comply, we reserve the right to remove any offensive content; terminate or limit the visibility of your account; retain data related to your account according to data retention Privacy Policy; and notify third parties — including law enforcement authorities — and provide them with information related to your account. This step may be necessary to protect the safety of our users and others, to investigate and address potential violations of the terms, and to detect and resolve any fraud or security concerns.
We also care about your physical safety while using our services. Do not use our services in a way that prevents you from following traffic or safety laws. For example, never use the services while driving. Don’t put yourself or others in harm's way.
In short: We try to make our services as safe as possible, but we need your help. These terms, the Social Interaction Guidelines, and other find me+ Privacy Policy contain important information about how to keep the services and other users safe. Don’t put yourself or others in harm's way when using our services.

10. Social Interaction Guidelines

We have established Social Interaction Guidelines to ensure the safety, respect, and positive experience of all users. By using the app, you agree to adhere to these guidelines, which cover the following prohibited behaviors:

• Sexual content involving minors or sexual exploitation

• Bullying, harassment, and doxxing

• Violent threats or harmful behavior

• Misinformation, spam, or impersonation

• Promotion of illegal activities

• Hate speech, terrorism, and violent extremism

Violations of these guidelines will result in actions such as content removal, account suspension, or termination. We reserve the right to report unlawful activities to law enforcement authorities.

11.Your Account
You need to create an account to use certain services. You agree to provide accurate, complete, and up-to-date information for your account. You are responsible for any activity that occurs within your account, so it’s important to keep it secure. One way to help keep your account secure is by choosing a strong password that you don’t use for any other account and enabling two-factor authentication. If you believe someone has gained access to your account, please use the tools we provide through your device’s settings. You agree not to create any account if we have previously removed, blocked, or deleted your account from any of our services, unless we agree otherwise.
In short: Keep your account and its details secure. Use only one account unless authorized by us.

12.Modifying Services and These Terms
We are constantly working to improve our services and create new ones. This means we may add or delete features, products, or functions, and we may suspend or stop the services altogether. We may take any of these actions at any time for any reason, and when we do, we may not provide you with prior notice.
This also means that we may need to update these terms to reflect any changes to our services or how we provide them, as well as to comply with legal requirements or for any other legal or security reasons. If these changes are substantial, we will provide you with reasonable prior notice (unless the changes are required sooner, for example, due to legal requirements or when we launch new services or features). If you continue to use the services once the changes take effect, we will consider it as your acceptance of the changes.
In short: Our services will evolve over time. We may update these terms from time to time to reflect these changes or for other reasons.

13.Termination and Suspension
While we hope you remain a Find me+ user for life, you can terminate these terms at any time if you disagree with any changes we make to these terms or for any other reason by deleting your Find me+ account.
We may restrict, terminate, or suspend your access to the services temporarily if you fail to comply with these terms, our Social Interaction Guidelines, or the law, for reasons beyond our control, or for any other reason. This means we may terminate these terms, stop providing you with all or part of the services, or impose new or additional restrictions on your ability to use our services. For example, we may deactivate your account due to prolonged inactivity, and we may reclaim your username at any time for any reason. While we try to give you reasonable prior notice, we cannot guarantee notice is possible in all circumstances.
When we restrict, terminate, or suspend your access to the services due to a violation of our Social Interaction Guidelines, we will notify you and provide you with an opportunity to appeal.
Before we restrict, terminate, or suspend your access to the services, we will take into consideration all relevant facts and circumstances based on the information available to us, depending on the reason for this action. For example, if you violate our Social Interaction Guidelines, we will consider the severity, frequency, and impact of the violations, as well as the intent behind them. This will determine whether we restrict, terminate, or suspend your access, and if suspended, for how long.
In short: You can stop using the services or delete your account at any time and for any reason, including if you don’t like any changes to these terms. We may restrict or terminate your access to the services for the reasons stated above. When we do so, we will usually provide you with notice and an opportunity to appeal the decision.

14.Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Find me+, its directors, officers, and shareholders from any claims, charges, demands, damages, losses, costs, fines, liabilities, and expenses (including attorney fees) arising from or related to: (a) your access to or use of the services, or any third-party products or services related to the services, even if recommended, enabled, or approved by find me+; (b) your content, including infringement claims related to your content; (c) your breach of these terms or any applicable law or regulation; or (d) your negligence or intentional misconduct.
In short: If you cause us harm, you will compensate us.

15.Disclaimer
We strive to keep the services running smoothly and without issues, but we can’t promise success.
The services are provided "as is" and "as available" to the extent permitted by applicable laws, without any warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. In addition, while we aim to provide a good user experience, we do not warrant that: (a) the services will always be secure, error-free, or timely; (b) the services will always operate without delays, disruptions, or imperfections; or (c) any content, user content, or information you obtain from or through the services will be suitable or accurate.
We do not take responsibility for any content created, transmitted, sent, received, or stored on or through our services by you, any other user, or any third party. You acknowledge that you may be exposed to content that could be offensive, illegal, misleading, or otherwise inappropriate, and we are not liable for it.
In short: Find me+ will try to make the services available to you, but we don’t make any promises regarding quality, and we are not responsible for content that does not belong to us.

16.Arbitration, Class Action Waiver, and Jury Trial Waiver
Please read the following sections carefully, as they require you and "FIND ME PORTAL" to resolve all disputes between us through binding individual arbitration.
A. Arbitration Agreement
In the event of any dispute or legal claim arising from or related to your use of the "Find me+" app or these terms, the dispute will be resolved through binding individual arbitration in accordance with the laws of the United Arab Emirates. Class action claims or the waiver of your rights to arbitration are not permitted.
B. Attempt to Resolve Disputes Informally First
We always aim to resolve disputes amicably and informally. If you have any dispute with us, please contact us first through [your contact details] to attempt to resolve the issue informally. If the dispute is not resolved within 60 days, either party may proceed with arbitration.
C. Arbitration Procedures
Arbitration will be conducted according to the applicable laws of the United Arab Emirates. A single arbitrator will be appointed to hear the dispute, and the arbitrator's decision will be final and binding on both parties. The costs of arbitration will be shared fairly by both parties.
D. Jurisdiction
In the event that arbitration does not resolve the dispute, the matter will be referred to the competent courts of the United Arab Emirates.
In short: Unless you exercise your right to opt-out, you and Find me+ will resolve all claims and disputes first through informal resolution, and if that fails, through individual binding arbitration. This means that you cannot bring a class action lawsuit against us in the event of a claim or dispute.

17.Acknowledgment
You acknowledge that the agreement is between you and Find me+ only, and not with Apple. Apple is not responsible for the application or the content thereof. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the application.

18.Scope of License
This license granted to you for the application is limited to a non-transferable license to use the application on any Apple-branded products that you own or control and as permitted by the App Store Terms of Use. The terms of this license will govern any upgrades provided by the developer, unless such an upgrade is accompanied by a separate license, in which case the terms of that license will govern.

19.Maintenance and Support
Find me+, not Apple, is solely responsible for providing any maintenance and support services with respect to the application, as specified in this agreement or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the application.

20.Warranty Disclaimer
To the maximum extent permitted by applicable law, Find me+ disclaims all warranties with respect to the application, either express, implied, or statutory, including, but not limited to, the implied warranties and/or conditions of merchantability, fitness for a particular purpose, and non-infringement. You acknowledge that Apple is not responsible for any warranty claims made by users or third parties.

21.Product Claims
You acknowledge that Find me+, not Apple, is responsible for addressing any claims by you or any third party relating to the application or your possession and/or use of that application, including, but not limited to:

• Product liability claims

• Any claim that the application fails to conform to any applicable legal or regulatory requirement

• Claims arising under consumer protection, privacy, or similar legislation

22.Legal Compliance
You must comply with applicable third-party terms of agreement when using the application (e.g., your wireless data service agreement). You agree not to use the application in any manner that would violate any law or regulation.

23.Intellectual Property Rights
In the event of any third-party claim that the application, or your possession and use of the application, infringes on that third party’s intellectual property rights, Find me+, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

24.Third-Party Beneficiary
You and Find me+ acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this agreement, and that upon your acceptance of the terms and conditions of this agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary thereof.

25.Final Terms
These terms, including any additional terms referenced in Section 3, constitute the entire agreement between you and Find me+ and supersede any prior agreements. These terms do not create or grant any third-party beneficiary rights. If we do not enforce any provision of these terms, it will not be considered a waiver of our right to enforce them. We reserve the right to transfer our rights under these terms and provide services through another entity, provided that entity supports these terms. You may not transfer any of your rights or obligations under these terms without our consent. All rights not expressly granted to you are reserved. Where we have included summary sections in these terms, they have been provided for your convenience only, and you should read the full terms to understand your legal rights and obligations.
